By paying the down payment, the client agrees to the information and general terms and conditions as well as to the offer. The order begins with the receipt of the deposit of 50% of the agreed services to Luxury Event Mallorca. The terms of payment are as follows: 50% at the beginning of the order, 50% 7 days before the event or at the latest on the day before the event begins.
Decorative items: The decorative items that are named in the offer, such as vases, lanterns, seat cushions, torches, lighting, party box, etc. are rented and do not constitute a purchase price. If items are damaged or lost, they must be replaced. The prices include the costs of delivery, organization and cleaning. The flowers include both real and synthetic flowers (depending on the package).
Access: The client guarantees that Luxury Event Mallorca by Mareike Jakél has access to the agreed locations and locations and that there is sufficient time for assembly and dismantling.
Set-up and delivery: The decoration will be delivered by arrangement before the start of the event. Depending on the scope, at least 1-3 hours or more must be calculated on site for the construction.
Picking up the items: The items will be removed after the respective part of the event (e.g. after the ceremony when the guests are no longer there and e.g. at dinner). If dismantling would impair the appearance of the event, we will wait until the end of the event or dismantle on the following day by arrangement. If significant additional work is incurred due to dismantling on the following day, travel costs and staff may be charged additionally. Within a radius of 30 kilometers, dismantling is possible on the following day free of charge.
Deposit: For orders from 900 € - a deposit of 350 € is deposited in advance for the decorative objects, which is paid back when the objects are picked up.
Jukebox: From 12:00 a.m. please ensure that the peace and quiet of the neighbors is not disturbed. The client confirms that he and his guests will comply with the legal requirements of the Spanish government and the Balearic Islands. In particular, this applies to noise protection regulations and decibel requirements (if these are required at the location).
Protection of objects: The client confirms that he will protect the jukebox or all other moisture-sensitive objects from rain and moisture and will store them in a dry place (interior) overnight.
Torches/LED/decorative items/pampas grass: In the event of heavy rain, the client will store the items/protect them from the rain.
If the objects are damaged by rain, moisture or other weather influences, the client will replace them.
Data protection for clients: I agree that my data (personal data such as name, address, telephone number, copies of ID cards/ID card number, tax number, etc.)
stored, processed and used for the following purposes:
- Delivery of the decoration and, if necessary, organizational processes that are requested by the client
For this purpose, Luxury Event Mallorca by Mareike Jakél may forward the data (name, address, tax number/ID number) to the respective service providers (catering, music, location, etc.). The provision of personal data is voluntary.
This applies indefinitely and I can revoke this at any time with effect for the future.
In this case, I will send my declaration of revocation in writing to Luxury Event Mallorca - Mareike Jakel.
The images in the offer give an approximate impression of the delivered decoration. Adjustments are made depending on the location and circumstances.
Force majeure: Luxury Event Mallorca by Mareike Jakél is not liable for performance disruptions due to force majeure or circumstances for which she is not responsible. And not for aggravation, danger or impairment of a significant kind, in particular not due to unforeseeable circumstances such as e.g. B. Obstruction by state organs or other persons, road blockades or quarantine measures, entry requirements...etc.
Catering: From a working time of more than 5 hours on the day of the event, the client agrees to take over the catering of the respective employees. Usually this amounts to around €30-50 per person. (This does not apply to marriage proposal packages)
Updates: The client agrees to always promptly communicate feedback, changes or news that are important for the decoration planning, support or follow-up and to participate in the exchange of necessary emails and telephone calls with Luxury Event Mallorca by Mareike Jakél Clients submit the final number of guests no later than 3 weeks before the day of the event (if this is relevant for the decoration). Seating plans or other special requests from clients and guests will also be submitted no later than 3 weeks before the day of the event.
Liability: The liability of Luxury Event Mallorca by Mareike Jakél - with the exception of cases of intent and gross negligence - is excluded. Luxury Event Mallorca by Mareike Jakél assumes no liability for loss of or damage to property belonging to clients or guests.
Furthermore, Luxury Event Mallorca by Mareike Jakél is not liable for third parties or commissioned companies. The client undertakes to indemnify the agency against any claims for damages by third parties arising from or in connection with the organization/decoration of the event. All processes are coordinated to the best of our knowledge and belief.
Confidentiality: Fee secret applies in general. The client also undertakes not to pass on ideas, ideas, format templates and designs to third parties on the basis of copyright and not to use them commercially himself.
Rebooking: If the date already set is to be moved to a new date due to force majeure or other circumstances, the rebooking is free of charge more than 6 months before the date.
Between 6 months and 1 month a fee of 10% of the order volume is calculated.
Less than 1 month before the event - 20% of the order volume and the client reimburses costs that have already arisen through acquisitions, purchases, etc. for the event.
If Luxury Event Mallorca by Mareike Jakél is not available on the new date, the deposit can of course be offset as a voucher.
Termination: If the client wishes to terminate the agreement prematurely or the event cannot take place, the expenses incurred up to that point will be invoiced by Luxury Event Mallorca by Mareike Jakél.
The agency has the right to terminate the contract if agreed installments are not paid by the client by the due date or for an important reason.
If the event is completely canceled, a service fee of €250 will be agreed for the administrative cancellation of the service and the client will reimburse costs that have already been incurred through acquisitions, purchases, etc. for the event.
If the notice period is less than 8 days, Luxury Event Mallorca by Mareike Jakél will receive 70% of the agreed flat rate.
Disputes: We will always try to find a common solution and invite you to a harmonious discussion. In the event that this should not be possible, the place of jurisdiction and performance is Palma de Mallorca - Islas Baleares.
Final provision: Should one or more provisions of this agreement between Luxury Event Mallorca by Mareike Jakél and the client be or become invalid, the validity of all other provisions or agreements shall not be affected. Rather, instead of the invalid provision, a regulation should apply that corresponds to the economic sense and purpose of the invalid provision in a legally permissible manner.
